Para tanto \u00e9 necess\u00e1rio utilizar-se de provas, podendo ser testemunhas, \u00e1udios\/v\u00eddeos captados no ambiente de trabalho, conversas gravadas com o patr\u00e3o, registros em rede social com farda da empresa, dentre outras. O Minist\u00e9rio do Trabalho \u00e9 o \u00f3rg\u00e3o respons\u00e1vel por classificar os agentes insalubres ou atividades perigosas aptas a gerar o respectivo pagamento do adicional. Para atividades insalubres o adicional varia de 10%, 20% ou 40% do sal\u00e1rio m\u00ednimo, dependendo do n\u00edvel de afeta\u00e7\u00e3o. J\u00e1 as atividades perigosas importam no pagamento 30% do sal\u00e1rio contratual. Em ambos os casos, para que a justi\u00e7a reconhe\u00e7a se a atividade \u00e9 insalubre ou perigosa \u00e9 necess\u00e1ria a realiza\u00e7\u00e3o de per\u00edcia t\u00e9cnica. Tal situa\u00e7\u00e3o gera o direito do empregado de reclamar uma indeniza\u00e7\u00e3o durante o per\u00edodo que durou a acumula\u00e7\u00e3o, que pode variar caso a caso, para suprir o trabalho a mais e desestimular o enriquecimento sem causa do empregador. J\u00e1 o desvio de fun\u00e7\u00e3o ocorre quando o empregado foge totalmente da fun\u00e7\u00e3o para a qual foi contratado e come\u00e7a a trabalhar em outra fun\u00e7\u00e3o. Nesse caso s\u00f3 haveria alguma repercuss\u00e3o pr\u00e1tica na hip\u00f3tese da fun\u00e7\u00e3o desempenhada ser melhor remunerada do que a fun\u00e7\u00e3o do contrato.
